Nos tempos modernos, a doutrina do direito natural tem sido negada por muitos autores. Não foi assim entre os medievais e entre os antigos. Tomás de Aquino, em diversas partes de sua obra, trata do tema e mostra como a própria racionalidade do homem o leva a descobrir algo que está insito no mais intimo de sua natureza.

O objetivo deste artigo é discutir a noção humiana de "crença", frequentemente vita como adendo "psicológico" à correta doutrina epistemológica do autor. Tenta-se sugerir que são partilha das obsessões da epistemologia contemporânea.

ResumoNo início do século xviii, Isaac Newton publicou seu principal trabalho sobre óptica, o Opticks. Impregnado por uma perspectiva indutiva, o livro logo se tornou a principal referência para os estudos sobre a luz e as cores, sendo amplamente popularizado pelos seguidores de Newton. Neste artigo, analisamos como dois importantes livros contribuíram para essa popularização e também qual era a imagem de ciência que tencionavam propagar, o Élements de la philosophie de Newton de Voltaire e o Newtonianismo per le dame (...) de Algarotti. Será possível perceber que ambos os autores distorceram o conteúdo do livro de Newton, no intuito de propagar uma imagem idealizada das ideias newtonianas e da própria filosofia natural.In the beginning of 18th century, Newton published his main work about light and colors, the Opticks. Impregnated by an inductive perspective, the book became the major reference for the studies about light and colors, being widely popularized by Newton's followers. In this article, we analyze how two important works contributed to this process of popularization and also what image of science they intended to propagate: Voltaire's Elements of Newton's philosophie and Algarotti's Sir Isaac Newton's philosophy explain'd for the use of the ladies. We will be notice that both authors distorted the content of the Opticks, in order to propagate an idealized image of Newtonian ideas and natural philosophy itself. (shrink)

Em um primeiro momento são apresentados e problematizados elementos centrais da filosofia estoica, tais como as noções de lei natural, liberdade interior, igualdade formal e universalismo. Em seguida, mediante (...) uma análise histórica e filosófica de caráter crítico-comparativo são apresentados os três principais projetos de república pensados pelos estoicos: 1) a república radical e igualitarista de Zenão (ap. 334 a.C. – 262 a.C.), na qual se nega a juridicidade, eis que o direito é entendido como construção artificial que impede a fruição da liberdade; 2) a república legalista de Cícero (106 a.C. – 43 a.C.), quando o direito natural é positivado para servir enquanto instância racional de auto-reflexão e de auto-fundamentação das normas jurídico positivas e, finalmente, 3) a “república” de Sêneca (4 a.C. – 65 d.C.), na qual o direito inicialmente se deixa absorver pelo poder pessoal do Imperador Romano para, em um segundo momento, mostrar-se como elemento universal, preparando assim as bases para a futura concepção de direitos fundamentais própria da modernidade. A crítica de Leibniz à prova a priori da existência de Deus, retomada de Anselmo por Descartes, resume-se à observação de que, antes de admitir a existência de um ser perfeitíssimo, é preciso provar a possibilidade d noção de um tal ser; e, para isso, é preciso mostrar a compatibilidade entre as perfeições divinas. A prova é correta, mas incompleta. Leibniz jamais completou essa prova, com exceção de um texto escrito em 1676, porque, para isso, precisaria lançar mão de sua (...) Característica universal, cujos elementos seriam os pensamentos simples que exprimiriam as formas simples ou perfeições divinas. O projeto de criação de uma língua formal ou Característica universal, embora tenha permanecido inacabado, jamais foi abandonado por Leibniz. Todavia, ao delinear o projeto, Leibniz esclarece que a Característica explicaria com exatidão as verdades necessárias, mas não as verdades contingentes. Ora, se fosse possível provar a compatibilidade entre as perfeições divinas,seria também necessário explicar como a incompatiblidade entre os mundos possíveis se origina dessa compatibilidade primordial; seria preciso explicar como o contingente nasce do interior do necessário. Instances of negative causation—preventions, omissions, and the like—have long created philosophical worries. In this paper, I argue that concerns about negative causation can be addressed in the context of causal explanation generally, and mechanistic explanation specifically. The gravest concern about negative causation is that it exacerbates the problem of causal promiscuity—that is, the problem that arises when a particular account of causation identifies too many causes for a particular effect. In the explanatory context, the problem of promiscuity can be solved (...) by characterizing the phenomenon to be explained as a contrast between two or more events or non-events. This contrastive strategy also can solve other problems that negative causation presents for the leading accounts of mechanistic explanation. Along the way, I argue that to be effective, accounts of causal explanation must incorporate negative causation. I also develop a taxonomy of negative causation and incorporate each variety of negative causation into the leading accounts of mechanistic explanation. (shrink)

This article aims to reduce the polarization that has characterized discussion of memory work in psychotherapy. First, the article attempts to help critics of memory work understand the cultural and historical context in which their arguments have been received by practitioners and victim advocates: There are good reasons why attacks on memory work have been viewed with suspicion. Second, the article tries to convince practitioners and victim advocates that there nonetheless are legitimate grounds for concern about some forms of memory (...) work. The goal here is to persuade practitioners whose work includes a focus on childhood trauma to be cautious in their use of memory recovery techniques, without undermining support for survivors of childhood sexual abuse. Upshot: According to its introduction, the aim of Enaction is to “present the paradigm of enaction as a framework for a far-reaching renewal of cognitive science as a whole.” While many of the chapters make progress towards this aim, the book as a whole does not present enactivism as a coherent framework, and it could be argued that enactivism’s embrace of phenomenology means it is no longer a theory of cognition.

Discrepancies between the Uniform Determination of Death Act (UDDA) and the adult and pediatric diagnostic guidelines for brain death (BD) (the “Guidelines”) have motivated proposals to revise the UDDA. A revision proposed by Lewis, Bonnie and Pope (the RUDDA), has received particular attention, the three novelties of which would be: (1) to specify the Guidelines as the legally recognized “medical standard,” (2) to exclude hypothalamic function from the category of “brain function,” and (3) to authorize physicians to conduct an apnea (...) test without consent and even over a proxy’s objection. One hundred seven experts in medicine, bioethics, philosophy, and law, spanning a wide variety of perspectives, have come together in agreement that while the UDDA needs revision, the RUDDA is not the way to do it. Specifically, (1) the Guidelines have a non-negligible risk of false-positive error, (2) hypothalamic function is more relevant to the organism as a whole than any brainstem reflex, and (3) the apnea test carries a risk of precipitating BD in a non-BD patient, provides no benefit to the patient, does not reliably accomplish its intended purpose, and is not even absolutely necessary for diagnosing BD according to the internal logic of the Guidelines; it should at the very least require informed consent, as do many procedures that are much more beneficial and less risky. Finally, objections to a neurologic criterion of death are not based only on religious belief or ignorance. People have a right to not have a concept of death that experts vigorously debate imposed upon them against their judgment and conscience; any revision of the UDDA should therefore contain an opt-out clause for those who accept only a circulatory-respiratory criterion. I defend a realist commitment to the truth of our most empirically successful current scientific theories—on the ground that it provides the best explanation of their success and the success of their falsified predecessors. I argue that this Best Current Theory Realism (BCTR) is superior to preservative realism (PR) and the structural realism (SR). I show that PR and SR rest on the implausible assumption that the success of outdated theories requires the realist to hold that these theories possessed truthful (...) components. PR is undone by the fact that past theories succeeded even though their ontological claims about unobservables are false. SR backpeddles to argue that the realist is only committed to the truth about the structure of relations implied by the outdated theory, in order to explain its success. I argue that the structural component of theories is too bare-bones thin to explain the predictive/explanatory success of outdated theories. I conclude that BCTR can meet these objections to PR and SR, and also overcome the pessimistic meta-induction. (shrink)

A novel "dream splicing" technique allows the objective evaluation of thematic coherence in dreams. In this study, dream reports were cut into segments and segments randomly recombined to form spliced reports. Judges then attempted to distinguish spliced reports from intact ones. Five judges correctly scored 22 spliced and intact reports 82% of the time ; 13 of the 22 reports were correctly scored by all five judges . We conclude that most dream reports contain sufficient coherence to allow judges to (...) distinguish intact from spliced reports. In contrast, abridged reports, which had all but their first and last five lines removed, were correctly identified in only 10 of 38 reports, suggesting that thematic continuity does not normally extend from the beginning to the end of dreams. The continuity identified in this minority of the reports depended on easily identifiable features, such as specific characters, objects, locations, and emotions, rather than on "latent" themes. Recent years have been blessed with an abundance of logical systems, arising from a multitude of applications. A logic can be characterised in many different ways. Traditionally, a logic is presented via the following three components: 1. an intuitive non-formal motivation, perhaps tie it in to some application area 2. a semantical interpretation 3. a proof theoretical formulation. There are several types of proof theoretical methodologies, Hilbert style, Gentzen style, goal directed style, labelled deductive system style, and so on. The (...) tableau methodology, invented in the 1950s by Beth and Hintikka and later per fected by Smullyan and Fitting, is today one of the most popular, since it appears to bring together the proof-theoretical and the semantical approaches to the pre of a logical system and is also very intuitive. In many universities it is sentation the style first taught to students. Recently interest in tableaux has become more widespread and a community crystallised around the subject. An annual tableaux conference is being held and proceedings are published. The present volume is a Handbook a/Tableaux pre senting to the community a wide coverage of tableaux systems for a variety of logics. It is written by active members of the community and brings the reader up to frontline research. It will be of interest to any formal logician from any area. (shrink)

Ian C. Jarvie developed the idea of situational logic in a subtle and effective way. He was also interested in, as well as a contributor to, the institution of academic publication. This chapter provides a situational analysis of an important recurrent pattern in academic publishing, namely, the concentration of work around particular topics, despite the fact that most such work will be unrewarded in the economy of esteem that is meant to be in play.

Stratified properties such as ‘happy unhappiness’, ‘ungrounded ground’, ‘fortunate misfortune’, and evidently ‘true falsity’ may generate dialetheias (true contradictions). The aim of the article is to show that if this is the case, then we will have a special, conjunctive, kind of dialetheia: a true state description of the form ‘Fa and not Fa’ (for some property F and object a), wherein the two conjuncts, separately taken, are to be held untrue. The particular focus of the article is on happy (...) unhappiness: people suffering from (or enjoying) happy unhappiness (if there is some situation or state of mind of this kind) cannot be truly said ‘happy’ or ‘unhappy’, but we can say they are both. In the first section three cases of conjunctive stratification are presented; in the second section the logic of stratified contradictions is explored. The last section focuses on eudemonistic ascriptions: stated that a is happy to be unhappy (or unhappy to be happy), should we say a is happy? unhappy? both? neither? (shrink)

It is almost universally believed that in quantum theory the two following statements hold: all transformations are achieved by a unitary interaction followed by a von-Neumann measurement; all mixed states are marginals of pure entangled states. I name this doctrine the dogma of purification ontology. The source of the dogma is the original von Neumann axiomatisation of the theory, which largely relies on the Schrődinger equation as a postulate, which holds in a nonrelativistic context, and whose operator version holds only (...) in free quantum field theory, but no longer in the interacting theory. In the present paper I prove that both ontologies of unitarity and state-purity are unfalsifiable, even in principle, and therefore axiomatically spurious. I propose instead a minimal four-postulate axiomatisation: associate a Hilbert space \ to each system \; compose two systems by the tensor product rule \; associate a transformation from system \ to \ to a quantum operation, i.e. to a completely positive trace-non-increasing map between the trace-class operators of \ and \; evaluate all joint probabilities through that of a special type of quantum operation: the state preparation. I then conclude that quantum paradoxes—such as the Schroedinger-cat’s, and, most relevantly, the information paradox—are originated only by the dogma of purification ontology, and they are no longer paradoxes of the theory in the minimal formulation. For the same reason, most interpretations of the theory interpret the same dogma, not the strict theory stripped of the spurious postulates. (shrink)

We investigate computability theoretic and descriptive set theoretic contents of various kinds of analytic choice principles by performing a detailed analysis of the Medvedev lattice of $\Sigma ^1_1$ -closed sets. Among others, we solve an open problem on the Weihrauch degree of the parallelization of the $\Sigma ^1_1$ -choice principle on the integers. Harrington’s unpublished result on a jump hierarchy along a pseudo-well-ordering plays a key role in solving this problem.

There is strong reason to doubt that the intuitions Chalmers' meta-problem focuses on are widespread or independent of proto-theoretical prompting. So it's unlikely that they result from factors connected to the nature of consciousness. In any case, it's only the accuracy of the problem intuitions that matters for evaluating theories of consciousness or revealing the nature of consciousness, not an explanation of how they arise. Unless we determine that they're accurate about consciousness, we mustn't assume that realism about consciousness incorporates (...) them, or that denying them means denying that consciousness exists. And we must assess whether they're accurate independently of how they arise. (shrink)

The project of this paper is to understand what a phylogenetic tree represents and to discuss some of the implications that this has for the practice of systematics. At least the first part of this task, if not both parts, might appear trivial—or perhaps better suited for a single page in a textbook rather than a scholarly research paper. But this would be a mistake. While the task of interpreting phylogenetic trees is often treated in a trivial way, their interpretation (...) is tied to foundational conceptual questions at the heart of systematics—questions whose answers are hotly disputed. I have previously argued that widely shared ideas about the meaning and interpretation of phylogenetic trees are inconsistent with species concepts other than some genealogical version of a phylogenetic species concept (Velasco 2008). Here I rely on a similar approach and concentrate on the implications of the necessary conditions underlying the inferences that we make using phylogenetic trees. I argue that common practices for the interpretation and use of trees are in conflict and that unacceptable principles about species as units of phylogeny must be given up. According to the view that I will develop, all phylogenetic trees depict the history of populations. The branches on trees represent collections of population lineages through time and the splits represent population lineage splits. This is true regardless of whether the tips of the trees are themselves populations, or are species or higher taxa. Although this conclusion might be paired naturally with a view that species must be monophyletic groups, this population-centric view of trees is independent of that view of species. If we still want to have species that are paraphyletic groups of populations, this is permissible as long as we also do not treat species as the units of phylogeny. This population-centric view opposes a species-centric view of phylogeny and might be called a “rank-free” approach since it entails that we do not need to determine which groups are species (which is partly a ranking question) in order to build a tree. This conclusion and the argument for it are meant to be consistent with, but not require, acceptance of the conclusions of Velasco (2008) regarding species. (shrink)

Human aesthetic experiences are pervasive; they are triggered by faces, art, natural scenery, foods, ideas, theories, and decision-making situations, among many sources, and seem to be a distinctive trait of our species. Our moral sense, understood as our capacity to judge events, actions, or people as good or bad, appropriate or inappropriate, also seems to be an exclusively human endowment (Ayala 2010). We define a class of formal systems inspired by Prawitz’s theory of grounds. The latter is a semantics that aims at accounting for epistemic grounding, namely, at explaining why and how deductively valid inferences have the power to epistemically compel to accept the conclusion. Validity is defined in terms of typed objects, called grounds, that reify evidence for given judgments. An inference is valid when a function exists from grounds for the premises to grounds for the conclusion. Grounds are described (...) by formal terms, either directly when the terms are in canonical form, or indirectly when they are in non-canonical form. Non-canonical terms must reduce to canonical form, and two terms may be said to be equal when they converge towards equivalent grounds. In our systems these properties can be proved through rules distinguished according to whether they concern types or logic. Type rules involve type introduction and elimination, equality for application of operational symbols, and re-writing equations for non-canonical terms. The logic amounts to a sort of intuitionistic system in a Gentzen format. To conclude, we show that each system of our class enjoys a normalization property. (shrink)

This article analyzes the complex relation of phenomenology and literature in the work of Husserl and Derrida. In the first part, I show that the limited ideality of the literary object necessarily situates it in a derivative region of phenomenology. In the second part, however, I problematize the regional status of literature by elaborating a brief but important footnote in which Husserl broadens the concept of literature to embrace all cultural products whatsoever. Yet, because even this broadened concept of literature (...) ultimately remains secondary for the phenomenologist, it only redoubles and ratifies the submission of literature to the more ideal objectivities of mathematical disciplines like geometry. The third part, finally, mobilizes Derrida’s notion of “dissemination,” prepared in and unintelligible apart from his early engagement with Husserlian phenomenology, in order to broach a notion of literature that the phenomenologist can neither circumscribe nor describe. A recent Carnegie Report on Nursing Education – Educating Nurses: A Call for Radical Transformation challenges the nursing profession to embrace an education model that integrates knowledge, skilled know how and ethical comportment. Placing ethics in such a prominent position in nursing education is a radical transformation. Teaching ethics must be intentional and it is integral to the development of individual nurses and the profession as a whole. The development of moral imagination has a prominent place in this new education (...) model. The moral imagination is the ability to ponder and wonder about the inherent rightness or wrongness of decisions, choices and behaviors. This paper will review some key issues relevant to teaching ethics and then explore what nurturing the moral imagination could do for nurses as they learn to apply abstract ethics concepts to their clinical practice. In its opening chapters, ‘Languages of the Unheard’ offers a broad account of militancy as an aid to democracy and a principled response to the intransigence of elites and the unresponsiveness of institutions to the public interest. It proposes an understanding of militancy as a civic virtue and a contribution to democratic politics, relying on a normative conception of ‘autonomous democracy.’ In the second part of the book, this understanding of admirable militancy is applied to a wide range of protest (...) styles, including the nonviolent civil disobedience promoted by Gandhi and King, the disruptive direct action of strikes and other forms organized disruption, the rioting and black blocs of militant street protest, and the armed insurgency promoted by both urban and rural guerrilla groups.
